We are committed to protecting the privacy and security of our users, customers, and website visitors in compliance with the General Data Protection Regulation (GDPR), the Dutch Implementation Act (UAVG), and other applicable data protection legislation.
This Privacy Policy explains how we collect, use, store, and share your personal data when you use our website, platform, APIs, and related services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read and understood this Privacy Policy.
2. Data We Collect
We collect personal data that you provide directly to us when you create an account, subscribe to a plan, contact our support team, or otherwise interact with our Services. This includes your name, email address, company name, billing information, and any other information you choose to provide.
We also collect data automatically when you use our Services, including your IP address, browser type and version, operating system, referring URLs, pages visited, time spent on pages, and other diagnostic data. This data is used solely to generate personalized recommendations and search results.
3. Legal Basis and Purpose of Processing
Under the GDPR, we process your personal data on the following legal bases: (a) performance of a contract, when processing is necessary to provide you with our Services and fulfill our contractual obligations; (b) legitimate interest, when processing is necessary for our business purposes such as improving our platform, preventing fraud, and ensuring security, provided these interests are not overridden by your rights; (c) consent, when you have given clear consent for us to process your personal data for specific purposes such as marketing communications; and (d) legal obligation, when processing is required to comply with applicable laws and regulations.
Your data is used to operate and maintain the Services, process payments and manage subscriptions, provide customer support, send transactional communications, improve our algorithms and platform performance, and, where you have opted in, send marketing communications about product updates and industry insights.
4. Your Rights Under the GDPR
As a data subject, you have the following rights under the GDPR: the right of access to request a copy of the personal data we hold about you; the right to rectification to request correction of inaccurate or incomplete data; the right to erasure ("right to be forgotten") to request deletion of your personal data under certain circumstances; the right to restriction of processing to request that we limit how we use your data; the right to data portability to receive your data in a structured, commonly used, machine-readable format; and the right to object to processing based on our legitimate interests, including profiling.
To exercise any of these rights, please contact our Data Protection Officer at privacy@raccomando.com. We will respond to your request within 30 days. 5. Data Retention and International Transfers
We retain your personal data only for as long as is necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. Account data is retained for the duration of your subscription and for up to 24 months after account closure. Behavioral and analytics data processed on behalf of our customers is retained in accordance with the data processing agreement in place with each customer.
Our primary data processing infrastructure is located within the European Economic Area (EEA). Where we engage sub-processors located outside the EEA, we ensure that appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs) approved by the European Commission, or we rely on an adequacy decision. A list of our current sub-processors is available upon request.
6. Security and Contact Information
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit and at rest, regular security assessments, strict access controls, and employee training on data protection practices. While no method of transmission over the internet is completely secure, we strive to use commercially acceptable means to protect your personal data.
